So I sold a game on ebay a month ago for my 360 - Half Life, the Orange Box. Played it once through, beat it, didn't really think I'd play it again so I sold it on ebay on Feb 24th and the buyer received in on the 27th. They left positive feeback that night: "nice item ,fast shippingA+ebayer!"

Then, tonight, I went into my e-mail to see "paypal dispute: item not as described" requesting a full refund for the item. They sent a message saying they never tried it until now and it definitely does not work on their son's system, or their son's friends system. They have good feedback (99.3% over 1000+ feedbacks), but this just oozes fishiness to me. I know for an undeniable fact it was sent out in working condition, and they also said when I first sent the game to "please send it quickly - it's a birthday present for my son THIS FRIDAY". So he got the game, never tried it for a month after his birthday, and now it doesn't work?

I said if they send it back in the original condition and I check it and it isn't working, I'll give a refund (which I feel is completely bull**** but I'll do it since I bend over backwards for people). Personally, I'm tempted to just escalate it directly with paypal but I've heard horror stories of paypal always siding with the buyer - what should I do? I really don't feel like getting gipped out of 40 bucks, but I also don't want a strike on my paypal account for no reason.

I'd contact paypal and reference the buyer's feedback. That is what feedback is for...to say if there is a problem. The chances that the buyer left positive feedback and then waited a month to even see if it worked is very unlikely. The only mistake i think you made is that you offered a refund. Personally, I wouldn't refund the money.

If you go through paypal, you can put in to send it back as is and you'll give them a refund. As far as I know, you can't say "if it doesnt' work" because hwo do they verify that. Your only real option is to just refund the money when/if they send it back.
