so Saturday night i went out with some buddies to a known food chain. I ordered a steak medium-well done and it came back a little redder than usual. It tasted good, but after the mean i started feeling fatigued and overtired. As soon as I get home i went straight for the washroom, about 10 minutes later i went to bed (10:30PM). After battling nausea for about 15 minutes lying in bed i began vomitting up my meal. Now i threw up 4 or 5 diffrent times within a 3 hour period. I went to sleep that night at 7:30AM. After the first time i threw up i called into my work and told them i couldent come in becase i was sick (I was supposed to work a 12 hour shift-part time). I dident go to the doctor because every little movement (turning from side to side in bed) lead ome to throwing up.
Now im contemplating complaining to the store, or asking for lost wages. Whats your opinions on this, and what would you guys do?

don't go looking for money...it's just the risk you take when eating out.

The first step you have to take is to go to the doctor if you expect to get anywhere if you don't go you can forget anything about lost wages because it is not documented. Little chance you'll get anywhere because you were eating stake and if you know or should have known the risk involved then they are not responsible. You also could have sent it back. If you could prove they were negligent in cooking it you might get somewhere in some courts, but you'll lose more money in legal fees and time than you'll ever gain back in compensation.

It's just one of those things that happens and you'd have to have proof beyond a reasonable doubt that it was something you ate there. Yes it probably was but can you besides saying " Well I wasn't sick until after I ate there " prove it was their food??

I thought I read somewhere that food poisoning takes time to work,for lack of a better word..
So,without a doctors diagnosis..You are 100% SOL..
And even with a doctor visit food poisoning is almost 100% hard to prove against a restaurant without several other patrons with the same illness..
And at this time of the year most would call it a case of the flu..Sad to say..

probably just a stomach virus or stomach flu....same thing happened to me a couple years ago after I ate Chinese. After nearly 12 hours of puking every 30 minutes and aching I called my mother to pick me up at 5am in the morning to take me to the ER. They told me it was a stomach bug going around. I honestly thought I was going to die.

You have to understand that food poisoning bacteria take time to multiply to an extent that will make you sick. It will usually take at least 6 or more likely 12 hours to get sick from bad food. Meaning, what you ate earlier in the day is most likely the culprit, not the reteraunt. Second, even if in a rare instance the food was so tainted it made you sick right away, the health department would need a sample of the food you ate at THAT time (ie what you may have taken home in a doggie bag) in order tio prove conclusively that the food was that certain resteraunts fault.
Basically, especially since you didn't go to a doctor, as bad as it was for you, you have no case. Sorry. Hope you're feeling better.

I have read where upwards of 80% of all short-term illnesses are food related.

How can you tell if its actual food poisoning? Maybe the steak just didn't agree with you, you yourself said you got it a bit rarer then usual, as you usually order it medium-well. It came back medium-rare and you still ate it.
I personally eat my steak medium-rare and never have issues with it. I think its just that your body doesn't normally eat something medium-rare is all.

Most you get out of them is a gift card as a goodwill sign. Almost all resturants have a sign posted somewhere that cautions about the consuming of under cooked animal products. The only way you get any actual money out of them is if they knowingly served you tainted food, otherwise it is an implied risk and you are not entitled to any compenstation.

LOL not that its funny, but word for word the same thing happened to me also couple of years ago. "I was going to die" oh ya. At one point I was thinking might be better then dealing with this again.
The first time I puked 8 times in 2 min. Nothing came out. I was sweating so much that it looked like I was running a marthon.
Few hours it came again. I said oh **** I cant deal with this again, but I had too.
That had to be thw hardest weekend of my life. Death seemed like a better option. J/K

Another tidbit people don't usually know, cuts of meat like steak have a very low instance of carrying food poisoning type of bacteria, because it is muscle and bacteria like ecoli and slamonella doesn't penetrate muscle. The bacteria may be on the outside but cooking it kills them. Even rare steaks are statistically safe from these bacteria. ground meat such as hamburger is quite different, you always want to make sure your hamburger is well done because it gets ground up and unlike staek, the bacteria penetrate the inside of the meat as well as outside so in order to kill the bacteria you must cook it all the way through.

If you really feel some kind of action should be taken just tell everyone you know that you got sick after eating there. That will do more harm than any complaining you'll do to the manager.

100% accurate. There is little to no chance that anything on the steak could have hit you that soon, based on the timeline you provided. You can report it to your local Health Department and ask them to contact you if they see other patrons that ate at the restaurant the same time you did also fall ill, but more than likely it is a circumstantial case at best. Sorry to hear about your bug, they are miserable experiences when they hit.

Yeah, very often stomach flu is mistaken for food poisoning.

Also 100% accuate. Lean beef is among the safest meats to eat from a food safety standpoint, whereas chicken is among the worse.
Never, under any circumstances, do you want to see pink still left in your chicken, even on a very thick chicken breast. Make sure it is always cooked all the way through or you risk a good case of salmonella, which can do serious damage to your gastrointestinal system, even your auto-immune system, and even can cause death.
And if you are handling raw chicken with your hands before cooking, make sure to wash 'em like a surgeon too, because that can transport bacteria even worse, obviously.
You must go to a physician and have tests done on a stool sample to determine what form of bacteria you were infected with (if any). Because the gestation period for some forms of "food poisoning" can be as much as 72 hours, the only proof you would have that the illness was the result of improper food preparation was if there were other similar cases diagnosed of patrons of the restaurant who have eaten there or where there the same night as you were. In short, take a sick day and forgetaboutit.
