MIAMI (AP) -- Cleveland Browns wide receiver Donte Stallworth will be charged Wednesday with killing a pedestrian last month while driving drunk in Miami, according to people familiar with the case.

Two people said an arrest warrant charging the 28-year-old Stallworth with DUI manslaughter will be filed Wednesday in the March 14 accident that killed 59-year-old Mario Reyes. The people requested anonymity because the charges haven't been announced.

The charge carries a possible 15-year prison sentence. Stallworth's blood-alcohol level after the crash was .12, well above Florida's legal limit of .08, according to results of a blood test. Stallworth will also be charged with DUI, according to the people informed about the case.

Stallworth, who is expected to surrender in court Thursday, released a statement last month saying he was "grief-stricken" over the accident.

A Miami Beach police report said that Reyes was not in a crosswalk on busy MacArthur Causeway when he was struck by the Bentley luxury car driven by Stallworth. The construction crane operator was trying to catch a bus home after finishing his shift around 7:15 a.m.

The report also quoted Stallworth as saying he flashed his lights at Reyes in an attempted warning and that Stallworth was driving about 50 mph in a 40 mph zone.

Stallworth signed a seven-year, $35 million contract with the Browns before last season but was injured much of the year. He previously played for New England, Philadelphia and New Orleans.

Stallworth is so stupid he should be charged with being an idiot.

The report also quoted Stallworth as saying he flashed his lights at Reyes in an attempted warning and that Stallworth was driving about 50 mph in a 40 mph zone.

Gee, Donte, maybe the guy didn't see you flashing your lights. Pedestrians have the right of way. Judge Judy would say if it doesn't make sense it's a lie. Why bother flashing your lights if you're going to hit the guy. On what planet does flashing your lights absolve you of any future crime? Dummy.

Stallworth: "But officer, I flashed my lights."

Nevermind the fact that he was driving drunk..

No, I know. It's just that I can see the whole Stallworth/police officer interaction from 2000 miles away.

Stallworth: "Officer, I had my seat belt on. I saw the gentleman, I even FLASHED him. I don't know what happened.

Basically he was trying to prove that he was a saint even though he was blitzed. Pathetic. What does flashing lights have to do with anything?

Pedestrians DO NOT have the right of way..The only way a Pedestrian has the right of way is in a cross walk with the WALK signal..

about 10 years ago I hit a guy in a crosswalk, without the signal, The guy was sighted for JAYWALKING, and failure to stop at an active signal, not to mention he took over 100 stitches to his legs, and a header into the street.

The fact he flashed his lights goes against him, if he saw him to flash he then was able to avoid hitting him. Wouldnt you think? You cant just assume the guy will get out of the way.
